On jan.1 2012, two of my motorcycles involve in an accident. The two were hit by a drunk driver of another motorcycle. The Yamaha dt was directly hit , the another one, honda wave was slightly damaged. I was not driving the two, in was borrowed by my friends. One of them, the rider of Yamaha Dt got severely injured and had to be operated in the hospital. He had file charges against the drunk driver, which happens to be without a license. My question is can I get my two motorcycles out form the impound even if the case is still on going? I didn't file any charges. Thank you.

If you have no fault, as well as the ones who were riding your motorcycle at the time of the accident, then there is no reason to impound your motorcycles. It is absurd that you will suffer when in fact you are the victim.

thank you for the response. The one that's driving my first motorcycle, the one that was actually hit and was critical at the hospital file charges against the drunk driver. Does it mean that the motorcycles will be in the custody of the police until the hearing of the case is finish?

You can get your car if you can show proof that you are the registered owner.

I think the motor vehicles involved in the accident are subject to be impound because they're considered as evidence to the case filed by your friend, even if he's not the registered owner. meanwhile, file a third party complaint for the recovery and damages.
