sometime in nov.2007 my daughters and a friend got mugged by a group of youngsters about 15 of them according to a guard who witnessed it..ranging from 15-22..5 lng un nahuli so i filed actions against them sa baranggay and subsequently sa fiscals ofc nun 2008. april 2011 a resolution was handed..all charges we filed were dropped pero un countercharge nila against 1 of my daughter was elevated sa court..they charged my daughter with physical injury ra7610. my daughter is out of the country now but a warrant has been served last thurs..what do we do now? do we have a way out of this..?

A criminal warrant does not have a statue of limitations (expiration period).

The warrant will remain valid until the named individual voluntarily presents themselves to authorities or is taken into custody.

kung babalik yung daughter mo sa pilipinas, better ready your "bail" payment after her voluntary presentation to the court. (syempre, uusad na ulit ang kaso na yan)

opo...we will do that...gano po kaya katagal bago matapos ang gantong kaso...ang kung may laban po ba kami...nakakalungkot lang po isipin...that in seeking justice...kami n ngaun ang hinahabol ng batas... will she be arrested po sa airport mismo or makakauwi pa kami and go directly to court and present herself and file bail?

Warrant can be served anywhere.

I suggest that you get a lawyer so your rights can be explained. Also how young is your daughter?

19 when it happened...and she's 23 now...we already hired a lawyer...and i requested for nbi assistance kasi gabi ang dating nya...voluntary surrender and first thing in the morning...we will post her bail..am i doing po ba the right thing? i dont want to risk my daughter's well being...
