i am a mother of 4, dont have job at present.
i found out just last week that my husband is living with a pregnant hooker fr.sangandaan caloocan.never noticed the affair earlier because of my husband's work. he is a contractor[small time] of a known bank so usually they work at night, but out of my knowledge, he is already living with the hooker 4 several mos.the hooker's husband broke the news to me.
i went their to see their place and was really shocked to see that their apartment is full of new furniture and branded appliances, w/c are better than ours at home, gosh. lots of groceries on the shelf. only now i realized the reason why we are experiencing scarcity of money since there was a lot of proj then...we were suffering fr. financial prob and the hooker has a 5'6, money lending in sangandaan public market as my husband told me but he never admitted he was the one who provide the capital. the hooker has all the luxury she could get and we are on the opposite side, we sometimes cant rent and cant pay bills on time..and the kids are still schooling..
can i use this things i discovered if i will be applying for a concubinage case against him? we are legally and spiritually married,tnx..

Yes. Based on the evidence you gathered, the elements of concubinage concur. Your husband is cohabiting with the concubine.

The elements of concubinage are:

a) The man must be married
b) He must commit any of the following acts:
i) by keeping a mistress in the conjugal dwelling
ii) by having sexual intercourse with a woman not his wife UNDER SCANDALOUS CIRCUMSTANCES
iii) by cohabiting with her in any other place
c) The woman involved must know the man is married

hi. just a curious case. why file a concubinage? maybe you should file for support not concubinage.

as penalty for the couple. according to the revised penal code article 334; the husband will be punished prison correccional which mean will be put to jail which mean he will ALSO provide no support and you will lose your husband.

and the concubine will be punished by destierro which means, Those sentence to destierro shall be precluded from entering the place or places designated in the sentence, or within the radius therein designated, which shall include a distance of 25 kilometers at least, and 250 kilometers at most, from the place designated.

in other words, your husband will be put to jail and the querida will be still free.

hi.were been separated for four years from now.and just recently my husband had a relationship with a girl.and shes pregnant now. while i'm into a relationship with the same sex.my partner advise me to sue my husband so we can have an annulment.what grounds do you think i can use.?.

Lesbianism and homosexuality is a ground for legal separation. And so is infidelity. If petition is granted, you cannot marry though. The marriage bond is not severed.

For Annulment, check out Articles 45 and 46 of Civil Code on the following:
* unless you got married without consent
* unsound mind
* fraud or non-disclosure
* force, intimidation or undue influence
* impotence
* STD

In annulment, marriage shall be defective at the beginning with above grounds existing at the time of marriage. If granted, you are free to marry.

What's left is a criminal case: Concubinage.

Just wondering though if there's love between you and your spouse for you to go through this tedious, expensive and humiliating experience to sever your marriage vow.

If you are happy with what you relationship you have, have peace. But if you want him back, fight for your right up to Supreme Court.

If no love, fight for a claim of support for your children. Under the law, they are entitled. What you need to do is write him a letter with actual breakdown of how much financial support your children needs. If he complains, tell him you will sue and he will be in jail.

Kung marami kayong ari-arian mag-asawa, you may want to get a lawyer para mahabol mo na ang lahat. BTW, whatever na ipinundar nya at ng hooker, sa inyong dalawa. Sa partehan, everything will return to you and your children.
