Implementing Rules and Regulations RA 9593 Section 122 (b)(4) Prior accreditation by the Department shall be required for the issuance of license or permit to operate primary tourism enterprises by the LGU.

However, Section 39 of Republic Act 9593 provides that “Nothing in this Section shall diminish the powers of the LGUs under the Local Government Code, pertaining to the issuance of business permits, licenses and the like. When an enterprise fails to obtain or loses accreditation, the Department shall notify the LGU concerned so that it may take appropriate action in relation to an enterprise’s licenses and permits to operate”.

What if there is an existing city ordinance before the passage of RA 9593 which does not provide for accreditation requirement under section 122, can the LGU be compelled to issue license or business permit?,..how do you reconcile the above-quoted provisions?,..do we need to make an ordinance or resolution in effecting national law?
