Hi guys,

I just like to know if Philippines has a law about cybersquatting. I was contacted yesterday by my domain name registrar that my site comicbookmovie.net is under investigation by UDRP (Uniform Domain Name Dispute Resolution Policy). I think the complainant is comicbookmovie.com. I'm just afraid that they may file a case against me. ... by the way, comicbookmovie.com is from United State.

The Philippines at the moment has not encountered much cases involving cyber crime. We therefore lack legislation pertaining to the aforementioned.

We have no law against cyber-squatting and regarding your issue, I think it is a futile attempt to sue you because you have the .net version. Domain names with different extensions are sold separately and therefore owners thereof can be different. You have free disposal of your property so why would they curtail that?

nabunutan ako ng tinik... Anyway, may nakita ako yesterday sa senate website regarding Anti-Cyber Squatting Act of 2010. Ito yung link - http://www.senate.gov.ph/photo_release/2011/0228_01.asp.

I thought na isa-batas na ang Anti-Cyber Squatting Act of 2010. May idea ka ba kung ano iyon?

According to wikipedia: Cybersquatting (also known as domain squatting), according to the United States federal law known as the Anticybersquatting Consumer Protection Act, is registering, trafficking in, or using a domain name with bad faith intent to profit from the goodwill of a trademark belonging to someone else.

As long as wala naman bad faith I think wala naman problema.

1. Pagsinabing Anti-Cyber Squatting Act of 2010 batas na ba sya? or proposed law pa lang sya?

2. If ever batas na sya... pede ba ako makasuhan or umandar ang kaso ng complainant kahit na sa US ang complainant?

3. Lusot ba ako? kung ngayon lang naipasa yung batas at na-register ko un domain name nun Jan 8, 2011 pa.

Pasensya na po sa dami ng tanong gusto ko lang po maka sigurado about this.

Actually yung comicbookmovie.net balak ko kasing gawing parang hobby site/blog na similar sa comicbookmovie.com. Pero I abandoned the site mid March. Na-realize ko nakakain na most of my time sa pag mamanage pa lng.
