Sometime ago we approach for his legal opinion regarding judicial partition of properties, his reccommendation is to exhaust all means to just have extra-judicial settlement. Now we filed a case praying for the appointment of my husband as an administrator to judicially partition the properties left by their parents, the same lawyer is now representing the sister of my husband to oppose his appointment, can we file a request for suspension of the said lawyer?

i also encountered such from our neighbor here in our province, actually, their lawyer was my prof in our school...they just asked for the lawyer to inhibit from the case.

Also, if you find sometime, you may read these sections under the Rules of Court...(im just a student in law, but i think this will help you)

2.) Sec. 6 ( when and to whom letters of administration granted) Rule 78

try reading and ask your lawyer to help you...
That's what i did with my sis impregnated by a high ranking officer in the army...reading law books and then asking my professors...hehheh
