according to phil labor code, short breaks should be included on 8hrs work.. what's not included is the 1hr break.. our co requires us to render 9.5 work hours per shift, 1.5 hrs are for 1hr long break & two 15mins short break.. are they not violating this law? thanks

it depends sa nature ng business ng company ninyo.

but as a general rule, 8 hours per day lang talaga. yung sosobra, overtime na yan.

and yes, short break is included in the 8hours of work.

in this case, are they violating the law?

'coz we're being required to render 9.5 hrs per day (1 hour long break & two 15min short breaks)..

as a rule short break time periods are considered compensable working hours hence part of the 8-hour a day. in excess of that, the employee is entitled to overtime premium. so, if your company is giving an overtime pay there is no violation on that premise alone.

so, there is a violation in our case?

see, we render 9.5 hours of work, short breaks are obviuosly not w/in the 8hrs work per day & it's not paid overtime.

What do we do if we want to report this to dept of labor or how do we go abt making an action on this?

You can call DOLE anonymously and ask them to investigate in your workplace. In doing this, all will be resolved.
