FACTS:
Petitioners claim 5% of original inventoried estate. In this claim, there is contention with respect on whether donation was inter vivos or mortis causa. The deed of donation was effected by David after adopting grandnieces.
HELD:
The donation is of mortis causa because the conditions set in are of the nature that will not take effect till the death of the donor.
