FACTS:
A parcel of land was donated for the construction of a school. The donation is subject to a resolutory condition. The school wasn’t constructed. The land was subsequently sold to Montejar. The donors sought to remove Montejar from the premises.
HELD:
It has been held that when a person donates land to another on the condition that the latter would build upon the land a school, the condition imposed is a resolutory one and not suspensive.
