FACTS:

Apolinia sought the recovery of a farm lot and house from Danguilan. She averred that she acquired the property through sale. Danguilan on the other hand, contends that the property is his by virtue of a donation.

HELD:

The donation being of real property, it is void for not complying with the requirements given by law. Donation of real property should be in a public instrument. In this case, it wasn’t.
