I. Concept: The crime committed by a private person who detains another without the attendance of any of the circumstances under Article 267. The penalty therefore is the same penalty imposed upon one who furnished the place of detention.
II. Special Mitigating Circumstances (1). If the victim is released within 3 days (2) without the purpose having been attained and (3) before institution of criminal proceedings. Note that this special mitigating does not apply if the detention is serious.
Thus if the woman victim was released after one hour, the same is not mitigating since the detention is already serious.
