FACTS:

Somodio paid ½ of the purchase price for a parcel of land. He started to construct a house but was left unfinished when he was employed in a far away area. He allowed Ayco to occupy the land but when he tried to demand Ayco to vacate the premises, the latter refused to do so.

HELD:

Possession in the eyes of the law doesn’t mean that a man has to have his feet on every square meter of ground before it can be said he is in possession.
